1. Acceptance of Terms

By accessing or using AICharmLab (the "App"), you ("the User") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, you may not access or use the App.

2. BETA Testing

2.1 BETA Status: The User acknowledges that AICharmLab is currently in BETA testing phase. Features, functionality, and user interface may change without prior notice as we improve the service based on user feedback and testing results.

2.2 Feedback Collection: During the BETA testing period, we may collect feedback, usage patterns, and performance metrics to improve the App. This information is collected solely for the purpose of enhancing the user experience and fixing issues.

2.3 No Guarantees: As a BETA service, AICharmLab may contain bugs or errors. We do not guarantee uninterrupted or error-free service during the BETA testing phase.

3. Nature of Service and No Warranties

3.1 AI-Generated Content: The App employs artificial intelligence algorithms to provide information, suggestions, or other outputs ("AI Content"). The User acknowledges and agrees that all AI Content is generated automatically and may include inaccuracies.

3.2 No Professional Advice: All AI Content is provided "as is" and for informational purposes only. The App does not provide professional, legal, financial, medical, or other specialized advice.

3.3 User Responsibility: The User bears sole responsibility for verifying the factual accuracy and suitability of any AI Content before acting upon it. The User understands that the App's outputs are to be used at their own risk, especially in any scenario that might lead to consequential outcomes.

4. Limitation of Liability

4.1 Use at Your Own Risk: The User assumes all responsibility for decisions, actions, or outcomes resulting from the use of the App and its AI Content.

4.2 No Liability for Damages: To the fullest extent permitted by law, AICharmLab, its affiliates, officers, directors, employees, agents, or licensors, shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App or any AI Content therein.

5. Data Usage and Privacy

5.1 Anonymized Data During BETA: During the BETA testing phase, you grant AICharmLab the right to collect and use anonymized conversation data and usage patterns generated through your use of the App. This data is used exclusively for improving our systems, enhancing AI models, and fixing technical issues. Anonymized data means that all personally identifiable information is removed before analysis.

5.2 Types of Anonymized Data: The anonymized data we collect may include conversation patterns, feature usage statistics, error reports, and performance metrics. We do not analyze the specific content of your conversations for any purpose other than improving the App's functionality.

5.3 No Sale or Sharing of Data - Ever: AICharmLab will never sell, rent, lease, or otherwise share your personal data or conversation content with third parties under any circumstances, unless specifically required by law or with your explicit consent. This commitment extends beyond the BETA testing phase to all future versions of the App.

5.4 Data Security: We implement appropriate technical and organizational measures to protect your data against unauthorized or unlawful processing, accidental loss, destruction, or damage.

5.5 Privacy Policy: For additional details on how data is collected, used, and protected, please refer to our Privacy Policy. By using the App, you consent to the data practices described therein.

6. Intellectual Property

6.1 Ownership: All trademarks, service marks, logos, trade names, and other proprietary designations ("Intellectual Property") displayed on or within the App are the property of AICharmLab or their respective owners. Nothing in these Terms grants you any right or license to use such Intellectual Property.

6.2 User-Generated Content: If the User uploads or provides any content to the App, the User represents and warrants that they have all necessary rights to do so. AICharmLab assumes no responsibility or liability for such content.

7. Modifications to the App

AICharmLab reserves the right to modify, suspend, or discontinue the App or any part thereof, at any time, without notice or liability to you. We may also update these Terms from time to time. Your continued use of the App after any changes to these Terms constitutes acceptance of such changes.

8. Indemnification

The User agrees to defend, indemnify, and hold harmless AICharmLab, its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal and accounting fees), arising out of or in any way connected with the User's breach of these Terms or misuse of the App, including reliance on or use of the AI Content.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of California, without regard to its conflict-of-law provisions. The User consents to the exclusive jurisdiction of the courts located in California for the resolution of any disputes arising out of or relating to these Terms or the use of the App.

10. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect, and the invalid or unenforceable provision shall be enforced to the maximum extent permitted by law.

11. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AICharmLab regarding your use of AICharmLab and supersede all prior or contemporaneous agreements, representations, and understandings.
